randevı

Terms of Use

⚠️ This text is not yet complete: the fields in square brackets will be filled in before release.

These Terms of Use (the "Terms") set out the rules between everyone who uses the Randevi and Randevi Business apps and the randevi.org website and Nihat Basmacı (sole proprietorship), who operates this service. Anyone creating an account declares that they accept these Terms; the text should therefore be read carefully.

This English text is a translation of the Turkish original. The Turkish text is authoritative; in case of any conflict, the Turkish text prevails.

In short: the Platform is a booking tool that brings Customers together with barbers, hairdressers, beauty salons and similar businesses. The service is provided by the Business and paid for at the Business; the Platform takes no payment from the Customer. The Customer can cancel an appointment without paying anything to the Platform. Businesses use the Platform on a subscription basis. This summary is for convenience only; the binding provisions are those set out below.

The following provisions are particularly important for Businesses: that the Business is the data controller in respect of Customer data, and the obligations arising from this (Section 12); the rules on automatic renewal of the Subscription, refunds and the right of withdrawal (clauses 13.7, 13.10 and 13.11); the restrictions that apply when the Subscription ends (clause 13.13); the limit on the Platform Operator's liability towards the Business and the Platform Operator's recourse against the Business (clauses 18.5 and 18.6); restriction and suspension of the account and termination of the contract (Section 19); changes to these Terms (Section 20); and the competent court (clause 22.5). The Business should read these provisions before submitting its application.

Sections 1-5, 8, 9 and 15-24 of this text apply to everyone. Sections 6 and 7 are specific to Customers, and Sections 10-14 are specific to Businesses.

1. Parties

1.1. One party to these Terms is Nihat Basmacı (sole proprietorship), who operates the Platform and is referred to in this text as the "Platform Operator". The Platform Operator's identifying details are as follows. Address: Mimar Sinan Mahallesi, 194. Sokak, Güzelbahçe Sitesi, No: 7-9, Atakum / Samsun. Email address: destek@randevi.org.

1.2. The other party is the person who uses the Platform, referred to in this text as the "User". A User may be a Customer who uses Randevi to book appointments or a Business that uses Randevi Business to manage its business. The same person may use both apps with a single account; in that case the relevant sections apply to each use.

1.3. The Platform Operator is not a party to the service relationship established between the Customer and the Business. The Platform Operator's role is explained in Section 4.

2. Definitions

2.1. Platform: the Randevi and Randevi Business mobile apps operated by the Platform Operator, the randevi.org website and the online appointment service offered through them.

2.2. Randevi: the Platform's app and web interface for Customers.

2.3. Randevi Business: the Platform's app and web interface for Businesses.

2.4. Customer: a natural person who browses businesses through the Platform or books an appointment with a Business.

2.5. Business: a natural or legal person that registers on the Platform, lists its services and accepts appointments, and that operates in fields such as barbering, hairdressing, beauty, nails, spa, wellness and the like. The persons who use Randevi Business on behalf of a Business in the roles of owner, manager and specialist are referred to as "Business users"; their actions bind the Business.

2.6. Business Service: the haircut, care and similar services that the Business provides to the Customer at its own premises.

2.7. Appointment: the record that the Customer creates through the Platform in order to receive a particular Business Service from a Business on a particular day and at a particular time. An appointment that has not yet been confirmed by the Business is referred to in this text as a "Request".

2.8. Content: any text, image and information that Users enter or upload to the Platform; for example a business profile, service list, photograph, review, reply and note.

2.9. Subscription: the paid membership governed by Section 13 that allows the Business to use Randevi Business.

2.10. Store: the app stores through which the apps are distributed, namely the Apple App Store and Google Play.

3. Acceptance and scope of the Terms

3.1. When creating an account on the Platform, the User declares that they accept these Terms. From that moment the Terms form a binding contract between the User and the Platform Operator. In addition, when applying to have its business published, the Business accepts the provisions of these Terms that relate to Businesses; the version to which this acceptance relates and the time of acceptance are recorded.

3.2. Visitors who use the parts of the Platform that are available without an account (browsing businesses, searching and viewing available times) are also required to comply with the rules of use in these Terms, in particular Section 15 and Section 16.

3.3. To create an account, the User must be at least 18 years old and must have the legal capacity to enter into this contract on their own (capacity to act). Persons under the age of 18 may not create an account on the Platform. A person who opens an account or acts on behalf of a Business declares that they are authorised to represent that Business.

3.4. How personal data is processed is explained in the KVKK Disclosure and in the Privacy Policy. Those texts are for information and are not part of this contract. Accepting these Terms does not mean giving explicit consent to the processing of personal data.

3.5. Receiving messages with campaign and promotional content is optional and is subject to a separate permission. Not giving this permission does not prevent use of the Platform; a permission that has been given can be withdrawn at any time from the notification preferences in the app.

4. The Platform's role: intermediation

4.1. The Platform is an intermediary service that enables Customers to find Businesses around them and to book appointments online, and enables Businesses to manage their calendar, their team, their customer records and incoming Requests.

4.2. The Business Service is provided by the Business in its own name, at its own premises and under its own responsibility. The contract for the Business Service is concluded solely between the Customer and the Business. The Platform Operator is not a party to that contract, the provider of the Business Service, or the representative, partner or employer of the Business.

4.3. Use of the Platform by Customers is free of charge. The Platform does not take any fee, commission, deposit or advance payment from the Customer under any name. No payment is made through the Platform and the Customer is not asked for card details. The price of the Business Service is paid directly to the Business, by the method the Business accepts at its premises; issuing an invoice or receipt is the obligation of the Business.

4.4. The business name, address, working hours, services, durations, prices, specialist information and photographs shown on the Platform are entered by the Business. The Platform Operator may review the Business's information at the application stage (Section 10); however, it does not continuously monitor the accuracy of services, prices and similar Content. The Business is responsible for the accuracy and currency of this information.

4.5. The price shown on the appointment confirmation screen is the price set by the Business, and it is written to the appointment record at the moment the Request is sent. Even if the Business later changes its price list, the existing appointment record does not change. For services with no stated price, the price is to be obtained from the Business.

4.6. The fact that a Business appears on the Platform, or that its application has been reviewed by the Platform Operator, does not mean that the Business has been inspected or guaranteed by the Platform Operator in terms of licensing, professional qualification, hygiene or quality of service.

4.7. Only Businesses that have been published on the Platform are listed in search and discovery results. Results are shown according to the province and district selected by the Customer and the search, filter and sorting options the Customer applies. The sorting options are "Recommended", "Nearest" and "Rating"; if the Customer makes no selection, the "Recommended" sorting is applied. In the "Recommended" sorting, the criteria are used in the following order of priority: the first criterion is, if the Customer has shared their location, the distance of the Business from the Customer (nearest first); if the Customer has not shared their location, it is the Business's average rating calculated from the reviews on the Platform (highest first). The second criterion is, if the Customer has entered a search text, the degree to which that text matches the Business's name, services and category. Businesses that are equal on these criteria are sorted alphabetically by name. If the Customer selects "Nearest", which requires location sharing, the first criterion is distance; if the Customer selects "Rating", the first criterion is average rating; the other criteria are applied in the same order. The Business's Subscription period, the price it pays to the Platform Operator or its link with a representative does not affect the sorting. The Platform Operator does not take a fee from Businesses in return for a higher position in the sorting; if such a practice is introduced in the future, the relevant results will be clearly marked as "advertisement".

5. Account and security

5.1. An account is created using one of the sign-in methods offered in the app, for example an email address and password. Which sign-in methods are offered may vary depending on the app version and the device used.

5.2. The User ensures that the first name, last name, telephone number and email address they provide are correct and their own, and keeps them up to date. The telephone number is requested so that the Business with which an appointment is booked can reach the Customer in connection with the appointment. A telephone number can be used on only one account.

5.3. A Customer who registers with an email address must verify that email address before being able to send an appointment.

5.4. The account is personal; it may not be transferred to someone else or left for someone else to use. The User keeps their sign-in details confidential. A User who suspects that their account has been used without permission should change their password, use the option in the app to sign out of all devices, and inform the Platform Operator.

5.5. The User is responsible for transactions resulting from their failure to protect their sign-in details. Unauthorised access resulting from the Platform Operator's fault is outside the scope of this provision.

5.6. The User may delete their account from within the app at any time. The consequences of deleting an account are explained in Section 19.

6. For Customers: booking and confirmation

6.1. No account is needed to browse Businesses, search and view available times. An account is needed to send an appointment.

6.2. An appointment is created in the following steps: on the Business's page the Customer selects the service, the specialist if they wish, the day and the time; on the confirmation screen the Customer sees the selected service, specialist, date, time and price; the Customer checks the details, goes back to correct them if necessary, and sends the Request. Every appointment sent is given an appointment code. The appointment record is stored in the Customer's account, and the current status of the appointment can be followed from the appointments section of the app.

6.3. Appointments can be booked only with Businesses that are published on the Platform and accept online appointments. Each Business determines in its own settings how far in advance at the earliest and how far ahead at the latest an appointment can be booked, whether it confirms appointments itself, and the notice it expects for cancellations. Appointment times are shown according to the local time of the place where the Business is located.

6.4. If the Business confirms appointments itself, the Request sent remains in "Pending approval" status and becomes final when the Business confirms it. If the Business has turned on automatic confirmation, the appointment is confirmed at the moment it is sent. An appointment is deemed final between the Customer and the Business at the moment it is confirmed; an unconfirmed Request does not bind the Business.

6.5. If the Business declines a Request, it states its reason and that reason is passed on to the Customer. A Request to which the Business has not responded is deemed automatically declined when 24 hours have passed since it was sent or when the appointment time arrives, whichever occurs first, and the parties are notified.

6.6. No more than one appointment is given to the same specialist for the same time slot. If two Customers select the same time at the same moment, only the Request completed first is recorded; the other Customer is asked to choose another time.

6.7. If the Customer does not select a specialist, a suitable specialist is assigned by the system. If the Customer has selected a particular specialist, the appointment is not moved to another specialist when it is created.

6.8. If, after the Customer has made their selection and before the Request is sent, the Business has increased the price or the duration of the service, the appointment is not recorded; the Customer is shown the current information and asked to confirm again.

6.9. The Customer may add a short note to the appointment to be passed on to the specialist; the Business sees this note. The Platform does not request special categories of personal data, such as health information, in this field; Customers are advised not to write such information in the note.

6.10. A Customer who has another appointment at the same time is warned but is not prevented from creating the appointment. It is the Customer's responsibility to ensure that their appointments do not overlap.

6.11. To prevent abuse, the number of Requests that can be sent is limited; no more than 20 Requests can be sent from one account within 24 hours.

6.12. The Customer agrees to attend a confirmed appointment on time and, if unable to attend, to cancel the appointment through the app at the earliest possible time.

7. For Customers: cancellation, change of time and not attending an appointment

7.1. The Customer may withdraw a Request that has not yet been confirmed at any time.

7.2. The Customer may cancel a confirmed appointment through the app, without having to give a reason, until the end time of the appointment. An appointment whose end time has passed cannot be cancelled.

7.3. Each Business determines how many hours before the appointment, at the latest, it expects cancellations to be made, and this period is shown to the Customer. The period is for information: the Customer may cancel the appointment even after the period has passed, and the Business is informed. The Platform does not take a fee or penalty from the Customer because of a cancellation; a late cancellation alone does not lead to any sanction being applied to the Customer's account.

7.4. The Customer may ask to change the time of their appointment. If the Business confirms appointments itself, the new time is submitted to the Business for confirmation. The existing appointment remains valid until the new time is confirmed.

7.5. If the Business wishes to change the time or the specialist of an appointment, it sends this to the Customer as a proposal. The proposal takes effect only if the Customer accepts it. The Customer may decline the proposal without giving a reason. If the Customer declines the proposal, or if the proposal is not answered within 24 hours or by the time of the appointment, the appointment continues at its existing time.

7.6. When the time is changed, the services and the price of the appointment are kept exactly as they are.

7.7. The Business may cancel a confirmed appointment by stating its reason; the reason is passed on to the Customer.

7.8. If the Customer does not attend the appointment, the Business may mark the appointment as "No-show" no earlier than 15 minutes after the start time of the appointment. The Customer is notified of this mark. The no-show record is visible only in the customer records of the Business concerned; it is not shared with other Businesses. The Platform does not take a fee or penalty from the Customer because of a no-show and does not automatically restrict the Customer's account for that reason; the cases of abuse in Section 15 are reserved.

7.9. A Customer who believes they were marked as "No-show" by mistake may first contact the Business. The Business can correct the mark on the day of the appointment or within 12 hours after marking. A Customer who does not obtain a result may write to the Platform Operator at destek@randevi.org; the Platform Operator assesses the request.

7.10. Confirmed appointments that the Business has not marked as "Completed" or "No-show" automatically move to "Completed" status 12 hours after their end time.

7.11. The possibility of cancellation in this section does not limit the Customer's right of withdrawal and other statutory rights arising from Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts. Where that legislation applies, the Customer may exercise the right of withdrawal by cancelling the appointment through the app or by giving notice to the Business or to destek@randevi.org; the Platform Operator immediately forwards any notice it receives to the Business. In the same cases, the right of withdrawal cannot be exercised, pursuant to Article 15(1)(h) of the Regulation on Distance Contracts, for services whose performance has begun with the Customer's approval.

8. Notifications and communication preferences

8.1. The Platform announces events that affect the status of an appointment, such as confirmation, decline, cancellation, a proposed change of time and a "No-show" mark, to the User concerned by in-app notification. If the User has given permission and it is technically possible, a push notification may also be sent and, depending on the type of event, an email. These notifications to the Customer are a necessary part of the service and cannot be turned off from the preferences in the app; push notification permission can be managed at any time from the device settings.

8.2. Appointment reminders and review invitations can be turned off from the notification preferences in the app.

8.3. The delivery of push notifications and emails depends on device settings, the permissions given, the internet connection and third-party infrastructure; the Platform Operator does not guarantee that they will be delivered in every case. The failure of a notification to arrive does not change the status of the appointment; the status shown in the appointments section of the app prevails.

8.4. Messages with campaign and promotional content are sent only with the permission separately given by the User under clause 3.5.

8.5. The Business may telephone the Customer or write to the Customer through messaging apps in connection with the appointment. This communication takes place outside the Platform and is the responsibility of the Business.

9. Reviews and content rules

9.1. A Business can be reviewed only by a Customer who has an appointment with that Business that has moved to "Completed" status. One review can be made for each appointment. A review consists of a rating between 1 and 5 and an optional comment of no more than 1000 characters.

9.2. Reviews are published publicly on the Business's page. The review shows the Customer's first name and only the initial of their last name (for example "Ayşe K.") and the name of the service received at the appointment.

9.3. The Business's rating is calculated automatically from the published reviews. The Business cannot change its rating and cannot remove a review on its own.

9.4. The Customer may edit or delete their own review. The Business may write one reply to each review; the reply is published together with the review. The Customer may state that their complaint has been resolved by the Business by editing their review, and the Business may state this in its reply; both are published in the same place as the original review.

9.5. Reviews that comply with the rules are published without distinguishing between positive and negative ones, and in date order from the newest to the oldest. A review remains published for at least one year from the date it is published; this is without prejudice to the author deleting the review or closing their account, and to the review being removed from publication under this section.

9.6. Reviews, replies and other Content entered on the Platform must comply with the rules below. These rules constitute the Platform's community rules.

a) Content must be based on a genuine experience; it must not be fake, misleading or written in return for a benefit.

b) Content must not contain insults, swearing, threats, harassment, discrimination or hate speech.

c) Content must not contain personal data belonging to someone else, such as a telephone number, address or identity information.

d) Content must not contain health claims that are contrary to legislation.

e) Content must not contain advertising, promotion or irrelevant statements.

f) Content must not be unlawful; it must not infringe the intellectual property rights, personality rights or other rights of others.

9.7. Any signed-in User may report a review that they believe breaches the rules to the Platform Operator using the report option in the app. Who made the report is not shown to the author of the review or to the Business.

9.8. The Platform Operator examines reports as soon as possible. The review remains published until a decision is made. At the end of the examination, the review is either left published or removed from publication. A review removed from publication does not count towards the Business's rating. The Platform Operator notifies the author without delay that the review has been removed from publication and of the reason; the author also sees this in the app. A review removed from publication cannot be edited or deleted by its author through the app, and a new review cannot be written for the same appointment; the author may ask the Platform Operator to delete that review.

9.9. An author or a Business wishing to object to the decision may apply to the Platform Operator at destek@randevi.org.

9.10. The User is responsible for the Content they enter on the Platform. Pursuant to Article 5 of Law No. 5651 on the Regulation of Publications on the Internet and Combating Crimes Committed through Such Publications, the Platform Operator is not obliged to check in advance the Content it hosts or to investigate whether an unlawful activity exists. The Platform Operator may examine and remove from publication Content that is reported to it as breaching these Terms. Where Content is reported to it as unlawful, the Platform Operator examines it; if it finds the Content to be unlawful, it removes the Content from publication without delay, and in the case of Content entered by a Business within 48 hours at the latest, and informs the User who entered the Content, giving its reasons.

9.11. Complaints and notices of unlawfulness concerning Content other than reviews, for example information or a photograph on a Business's page, may be sent to destek@randevi.org.

10. For Businesses: application, review and publication

10.1. A business may be registered on the Platform only by the owner or authorised representative of that business. The account that creates the Business takes the owner role of the Business. The Platform is open only to premises located in Türkiye.

10.2. For the Business to be published, the following information and documents are requested in the application: legal name; tax office; tax identification number, or Turkish identity number for sole proprietorships; tax certificate; the province of the premises and their location on the map; and the minimum content specified in the app, namely services, specialists, working days and photographs.

10.3. The Business declares that the information and documents it provides in the application are correct, up to date and its own. The Business updates any changes to its name, tax identification number and contact details (address, email address and telephone number) through Randevi Business no later than the end of the day following the change; it notifies the Platform Operator within the same period of any information it cannot update through the app. To verify the information, the Platform Operator may request additional information or documents during or after the application, for example the MERSIS number from Businesses that are merchants, and may periodically re-check that this information is up to date.

10.4. As a rule, applications are reviewed by the Platform Operator before publication; clause 14.2 is reserved. The Platform Operator may also review published Businesses afterwards. The review period varies with the volume of applications, and the Platform Operator gives no binding commitment as to time. While the review is in progress, the Business may prepare by using Randevi Business; however, it is not shown to Customers until its application is approved.

10.5. If the application is approved, the Business is published and its owner is notified. If the application is rejected, the reason is notified to the owner; the Business may remedy the deficiencies and apply again.

10.6. The Business may temporarily pause online booking from the app. During the pause, the Business's page continues to be visible and existing appointments are preserved, but no new online Requests are received.

11. For Businesses: obligations

11.1. The Business accepts that it uses the Platform in the course of its commercial or professional activity, that it holds the licences, permits, registrations and professional qualifications required for its activity, and that it provides the Business Service in compliance with the legislation in force.

11.2. The provider of the Business Service is the Business. The Business itself is responsible towards the Customer for the nature and safety of the service, its price, its documentation by invoice or receipt, and its obligations under consumer legislation.

11.3. The Business keeps the name, address, location, contact details, working hours, services, durations, prices inclusive of taxes, specialist information and photographs it enters on the Platform correct and up to date; it does not use deceptive or misleading Content. The Business uploads only images it has the right to use and is deemed to have obtained the permission of the persons appearing in the images.

11.4. The Business responds to incoming Requests within a reasonable time. It performs an appointment it has confirmed with the service, specialist, date and time in the appointment record, and does not exceed the price shown in the appointment record except for additional services expressly accepted by the Customer.

11.5. When declining a Request or cancelling a confirmed appointment, the Business states its reason; this reason is shown to the Customer. The Business limits cancellations to cases of necessity and makes them at the earliest possible time.

11.6. The Business may change the time or the specialist of an appointment only with the Customer's approval. When narrowing its working hours or adding leave or a closed day, the Business decides, for each appointment affected by the change, whether to move it or cancel it.

11.7. The Business uses the "No-show" mark only when the Customer has genuinely not attended, and corrects an incorrect mark.

11.8. The Business may manually record in its calendar appointments arranged at its premises or by telephone, and may record its customers who do not use the Platform by name and, if it wishes, telephone number. The Business is responsible for the accuracy and lawfulness of these records; details are in Section 12.

11.9. The owner and managers of the Business may invite team members to the Platform. Invitation links are single-use and valid for 72 hours. The roles are as follows: the owner manages all settings of the Business, and only the owner can carry out the Subscription, transfer of ownership and closure of the Business; a manager manages the calendar, services, customer records and specialists; a specialist manages their own calendar and their own appointments. The Business is responsible for its team's actions on the Platform and removes the access of persons who leave without delay.

11.10. The names and titles of specialists are shown to Customers. The Business informs the persons concerned before entering information about its team members on the Platform.

11.11. The Business may not write, or have others write, reviews for itself, may not procure reviews in return for a benefit, and may not pressure Customers to change or delete their reviews.

11.12. The Business responds directly and within a reasonable time to the Customer's requests and complaints concerning the Business Service. The same obligation applies to complaints forwarded to the Business by the Platform Operator.

12. For Businesses: customer data

12.1. When a Customer books an appointment with the Business, the Platform shows the Business, so that the appointment can be performed, the Customer's first and last name, telephone number, appointment details, the note written on the appointment, the reason for cancellation if any, and the Customer's appointment history at that Business. The Customer's email address is not shown to the Business.

12.2. The Business may use this data only for performing the appointment and for communication related to the appointment, for example notice of a change of time, a delay or a cancellation. The Business may not use this data outside these purposes, share it with third parties or sell it; it may not use it for marketing purposes without a valid permission given separately by the Customer to the Business.

12.3. In respect of the Customer data passed on to it, the Business is a data controller separate from the Platform Operator under Law No. 6698 on the Protection of Personal Data. The Business is responsible for the security of this data, for processing it lawfully and for answering the requests that Customers address to it.

12.4. In respect of the records that the Business enters in Randevi Business by its own decision, namely customer records it adds manually, internal customer notes, and name, title, working hours and leave records relating to team members, the data controller is the Business. The Platform Operator processes this data as a data processor, solely for the purpose of providing the Platform service, on behalf of the Business and in line with the instructions the Business gives through the Platform. Informing these persons, ensuring a legal basis for the processing and answering the requests of these persons are the obligations of the Business.

12.5. The Platform Operator takes appropriate technical and organisational measures to protect the data covered by clause 12.4; it does not use this data for its own purposes; it does not share it with third parties other than the infrastructure providers it uses to deliver the service; and it informs the Business without delay when it becomes aware of a data breach concerning this data. The Platform Operator hosts and processes this data on servers located abroad that belong to the infrastructure providers listed in the Privacy Policy; the place where the data is hosted is: currently South Korea (Seoul). The Business authorises the use of these providers as sub-processors; the Platform Operator announces changes to these providers in advance by updating the Privacy Policy. The transfer of this data abroad is carried out under [CROSS-BORDER TRANSFER BASIS] pursuant to Article 9 of Law No. 6698.

12.6. The Platform Operator forwards to the Business without delay any requests it receives from data subjects concerning the data covered by clause 12.4, and provides reasonable support so that the Business can answer those requests. After the contract ends, the Platform Operator retains this data for as long as a user account is linked to the Business's record. When the last user of a closed Business also deletes their account, the manually added customer records, the internal customer notes and the contact details in team invitations are deleted; the name, title, working hours and leave records relating to team members remain together with the Business's record, and the Business may request their deletion through the channels in clause 23.1; retention obligations arising from legislation are reserved.

12.7. The Business does not write special categories of personal data about Customers, such as their state of health, or insulting statements in internal notes and other free-text fields. Internal notes are not shown to the Customer; however, the Customer's rights under legislation in respect of this data are reserved.

12.8. Team members should access Customer data only to the extent their duties require. When a person's relationship with the Business ends, the Business removes that person's access.

12.9. The communication the Business establishes with the Customer outside the Platform, for example by telephone or messaging apps, and any data sharing it carries out in the course of that communication, are the responsibility of the Business.

12.10. If the Business wishes to send Customers messages with campaign or promotional content, it obtains the required permission itself and fulfils the record-keeping obligations itself under Law No. 6563 on the Regulation of Electronic Commerce and the Regulation on Commercial Communication and Commercial Electronic Messages. The Platform Operator does not collect commercial electronic message permissions on behalf of Businesses.

12.11. The Business informs the Platform Operator without delay when it becomes aware of a data breach concerning Customer data.

12.12. When a Customer deletes their account, the appointment records in the Business's calendar remain; however, the link between those records and the Customer's account is removed, and the appointment note and cancellation reason written by the Customer, as well as the internal notes the Business kept about that Customer, are deleted.

13. For Businesses: subscription

13.1. Use of Randevi Business is subject to a Subscription. The Subscription is separate for each Business and can be purchased and managed only by the owner of the Business. No subscription fee is taken from Customers.

13.2. A 30-day free trial period starts automatically at the moment the Business is published on the Platform. No payment information is requested for the trial, and no fee is charged automatically when the trial ends. Each Business benefits from the trial period once. A notification is sent to the owner of the Business before the trial period ends.

13.3. There is a single Subscription plan; two period options are offered, monthly and yearly. The features covered by the Subscription and its current price inclusive of taxes are shown on the purchase screen before purchase.

13.4. Where in-app purchase is offered, the Subscription is purchased through the Store. Payment is collected by the Store; the Platform Operator does not see or store payment card details. No purchase is made through the website; a Subscription purchased from the Store is also valid on the website.

13.5. In periods when in-app purchase is not offered, the Subscription may be set up for a specific period by the Platform Operator's support team at the request of the Business owner. The duration of this arrangement and its conditions, if any, are notified to the owner of the Business in advance.

13.6. The Platform Operator does not demand any fee that is not set out in these Terms or in the conditions expressly notified to the Business before purchase.

13.7. A Subscription purchased through the Store renews automatically for the same period at the end of each period unless it is cancelled, and its price is collected by the Store.

13.8. The owner of the Business may cancel the Subscription at any time from the subscription settings in their Store account. The cancellation takes effect at the end of the current period; the Business continues to benefit from the Subscription until that date. To avoid being charged for the next period, the cancellation must be made before the renewal date and within the time specified in the Store's rules. Deleting the app does not cancel the Subscription in the Store.

13.9. If the renewal price cannot be collected, the Subscription continues for the grace period allowed by the Store; if payment is not completed within that period, it ends.

13.10. Because payment is collected by the Store, refund requests are made to the Store and are concluded according to the Store's rules. When the Store approves a refund, the relevant Subscription ends immediately. This clause does not remove the Business's rights under legislation.

13.11. Because the Business purchases the Subscription for its commercial or professional activity, the right of withdrawal that Law No. 6502 on the Protection of Consumers grants to consumers does not apply to the Subscription.

13.12. Increases in the Subscription price are notified to the owner of the Business at least 30 days in advance and apply at the earliest from the renewal period following the notice. A Business owner who does not accept the increase may cancel the Subscription before the renewal date. The Store's own rules on price changes are reserved.

13.13. When the Subscription ends, including where the trial period ends without a Subscription being purchased, the following consequences arise.

a) The Business is not listed in search and discovery results; its page states that online appointments cannot be booked, and no new online Requests can be received.

b) The Business cannot confirm pending Requests, add appointments manually or move appointments; it cannot change its services, specialists, working hours or team invitations; the calendar becomes read-only.

c) Existing appointments are preserved. The Business can decline pending Requests, cancel appointments and mark them as "Completed" or "No-show"; Customers can cancel their existing appointments.

d) The Business's data is not deleted for this reason; when the Subscription is restarted, the restrictions are lifted.

13.14. The owner of the Business may transfer ownership to a team member of the Business who has an account on the Platform; the transferor moves to the manager role. A Subscription purchased from the Store remains in the transferor's Store account and does not pass to the new owner; the transferor must separately cancel that Subscription from their Store account. After the transfer, the Business is given a transition period of up to 14 days so that the new owner can start their own Subscription.

13.15. With one owner account, Subscriptions can be run for no more than five Businesses at the same time; for more, the Platform Operator must be contacted.

14. For Businesses: referral code and representatives

14.1. The Platform Operator may work with representatives who refer businesses to the Platform. During the application, the Business may enter a referral code belonging to a representative; entering a code is optional.

14.2. The review procedure applied to the publication of applications made with a valid referral code is as follows: [REVIEW PROCEDURE FOR REFERRAL-CODE APPLICATIONS]. The Platform Operator reserves the right to review these Businesses afterwards and to take action under Section 19 in the event of a breach of these Terms.

14.3. Entering a referral code does not result in any additional fee or discount for the Business. The representative may receive from the Platform Operator a share of the Subscription revenue of the Business it referred; this share is borne by the Platform Operator and is not collected separately from the Business.

14.4. The link between the Business and the representative is established once, during the application; it cannot be changed or removed afterwards.

14.5. Representatives are not authorised to change these Terms on behalf of the Platform Operator or to make commitments that are not contained in these Terms. The Platform Operator is bound only by these Terms and by the Platform Operator's own written notices.

15. Prohibited uses

15.1. The User uses the Platform only in compliance with the law and these Terms. The following conduct is prohibited.

a) Giving false identity, contact or business information; opening an account on behalf of someone else or with someone else's details.

b) Creating an appointment without intending to attend; sending Requests in order to fill a Business's calendar or obstruct its operation.

c) Accessing the Platform with bots, scraping software and similar automated tools; collecting data on the Platform in bulk or attempting to exceed usage limits.

d) Attempting to circumvent the Platform's security measures or to gain unauthorised access to the accounts or data of others; copying, modifying or reverse-engineering the Platform's software other than in the cases permitted by legislation.

e) Collecting or sharing the personal data of others without permission, or using it for a purpose other than the appointment.

f) Entering Content that breaches the rules in Section 9; writing, or having others write, fake reviews or reviews in return for a benefit.

g) Using the Platform to send unsolicited commercial messages.

h) Using the Platform for an unlawful purpose or in a way that infringes the rights of others.

15.2. For the security and fair use of the Platform, limits are applied to the number of certain operations; when a limit is exceeded, the operation is refused for a period of time.

15.3. Where a reasonable suspicion arises that these prohibitions have been breached, the Platform Operator may take the measures in Section 19.

16. Intellectual property

16.1. The rights in the Platform's software, design, interface, texts and images, and in the names and logos "Randevi" and "Randevi Business", belong to the Platform Operator or to the Platform Operator's licensors. The open-source components in the Platform are subject to their own licences; these licences are shown on the open-source licences page in the app.

16.2. The Platform Operator grants the User a limited, non-transferable, non-exclusive and revocable permission to use the Platform in compliance with these Terms for their own personal use or for the Business's own activity. This permission does not include the right to copy, modify or resell the Platform or to use the Platform Operator's names and logos without permission.

16.3. The rights in the Content the User enters on the Platform remain with the User. The User grants the Platform Operator a free and non-exclusive permission to display this Content on the Platform, namely in the apps, on the pages at randevi.org and in the Business's sharing links and QR codes, to reproduce it for this purpose and to make technical adaptations such as resizing. This permission ends when the Content is removed from the Platform; retention obligations arising from legislation are reserved.

16.4. The User declares that they have the right to use the Content they enter on the Platform and that the Content does not infringe the rights of others.

16.5. Persons who believe that Content on the Platform infringes an intellectual property right may apply to destek@randevi.org. The application contains the document showing ownership of the right, the applicant's identity and contact details, the address on the Platform of the Content complained of, and the grounds of the infringement. If the Content was entered by a Business, the Platform Operator, upon a duly made application, removes the Content from publication within 48 hours at the latest and notifies the applicant and the Business that entered the Content; the Business may object with information and documents showing that there is no infringement. If it is clear from the information and documents submitted that the objection is justified, the Content is published again. Clause 9.10 applies to other Content. The right of those concerned to apply to the courts and to the competent authorities is reserved.

17. Continuity of the service and changes

17.1. The Platform Operator takes reasonable care to keep the Platform secure and accessible; however, it does not undertake that the Platform will operate without interruption or error. The service may be temporarily interrupted or restricted because of maintenance, updates, security measures, failures in third-party infrastructure or reasons beyond the Platform Operator's control. The Platform Operator announces planned interruptions in advance where possible.

17.2. The Platform Operator may change the features of the Platform, add new features or remove a feature for the purposes of legal compliance, security, technical necessity or improvement of the service. Changes that significantly and adversely affect the User's use of the Platform are announced a reasonable time in advance.

17.3. For the Platform to operate securely, it may be necessary to use the current version of the app. In versions that are no longer supported, the app may be unusable until it is updated.

17.4. The Platform works together with, or links to, services provided by third parties, such as maps, identity verification, notification delivery, app stores, directions and messaging apps. Use of those services is subject to the relevant providers' own terms.

17.5. If the Platform Operator decides to discontinue the Platform or a service entirely, it informs Users a reasonable time in advance.

18. Liability

18.1. The Business is responsible for the provision, nature, safety, price and legal compliance of the Business Service. The Customer addresses requests and complaints concerning the Business Service first to the Business. The Platform Operator forwards the requests and complaints it receives to the relevant Business without delay, informs the Customer of the outcome and makes reasonable efforts towards a resolution.

18.2. The Platform Operator is liable, within the framework of the legislation in force, for damage arising from its own fault in operating the Platform.

18.3. Unless it is at fault, the Platform Operator is not liable in the following cases: the information entered on the Platform by the Business being incorrect or incomplete; the Business declining a Request, cancelling an appointment or failing to provide the service properly; the Customer not attending the appointment or cancelling it late; the Content entered by Users; failures arising from the User's device, internet connection or third-party services.

18.4. No provision of these Terms removes or limits the Platform Operator's liability arising from its intent or gross fault, its liability arising from death or personal injury, the consumer's rights under legislation, or the obligations the Platform Operator assumes as an intermediary under legislation.

18.5. Applicable to Businesses only: unless it has acted with intent or gross fault, the Platform Operator is not liable for indirect losses such as loss of profit, loss of customers and loss of reputation. The Platform Operator's total liability towards the Business is limited to the total price paid by the Business for the Subscription in the twelve months preceding the event giving rise to the loss. Clause 18.4 is reserved.

18.6. If, because of the Business's conduct in breach of these Terms or of legislation, the Platform Operator is obliged to make a payment to a Customer, a third party or a public authority, the Platform Operator may claim the amount it has paid from the Business in proportion to the Business's fault.

18.7. For the duration of events beyond the parties' control, such as natural disaster, fire, epidemic, war, strike, widespread infrastructure or internet outage and a decision of a public authority, the parties cannot be held liable for the obligations they are unable to perform because of those events.

19. Suspension, closure of the account and end of the contract

19.1. These Terms remain in force for an indefinite period, from the creation of the account until its closure.

19.2. The User may close their account at any time, without giving a reason and without paying any fee, using the account deletion option in the app. When the account is deleted, upcoming confirmed appointments are cancelled, pending Requests are withdrawn and the Businesses concerned are informed; the User's profile, favourites, notifications, declaration and permission records and the reviews they wrote are deleted; appointment records remain in the Businesses' records with their link to the account removed and with the notes and reasons written by the User deleted. This action cannot be undone; the User may register again later if they wish. The Platform Operator's obligations concerning the records it is required to retain under legislation are reserved. Which data is deleted and which is retained, and for what reason, is explained in the KVKK Disclosure and in the Privacy Policy.

19.3. A User who is the sole owner of a Business cannot delete their account without first transferring ownership or closing the Business.

19.4. The owner of the Business may close the Business from the app at any time by stating the reason. Closure cannot be undone; the Business can be reopened only with the Platform Operator's support. As a result of closure, future appointments are cancelled and Customers are informed; pending team invitations are cancelled; the access to the Business of team members other than the owner ends; the Business is removed from search and discovery and cannot receive online appointments. The Business record is not deleted, in order to preserve the integrity of Customers' past appointment records.

19.5. A Subscription purchased through the Store is not cancelled automatically when the account is deleted or the Business is closed; the Business owner must separately cancel the Subscription from their Store account.

19.6. In the following cases the Platform Operator may remove Content, stop the publication of a Business, restrict certain features of an account, suspend the account, or terminate the contract and close the account.

a) A serious or repeated breach of these Terms, in particular of Sections 9, 11, 12 and 15.

b) The provision of false information or documents.

c) Conduct that endangers the security of the Platform or of other Users, or that gives rise to a suspicion of fraud or abuse.

d) A requirement of legislation or of a decision of a competent public authority.

19.7. The Platform Operator determines the measure it will take in proportion to the seriousness of the breach. Except in cases where delay would be harmful, namely security, suspicion of fraud, legislation or a decision of a public authority, the Platform Operator informs the User, with its reasons, before applying the measure and allows a reasonable time to remedy the breach or to provide an explanation; for Businesses this time cannot be less than three business days. The Platform Operator notifies its decision concerning a Business, with its reasons, within seven business days of receiving the Business's explanation or, if no explanation is provided, at the end of the time allowed. For measures applied immediately, the reason is notified together with the measure or immediately afterwards. These notices to Businesses are given through both of the channels specified in clause 23.2. During a restriction or suspension, the Business continues to carry out the transactions relating to its existing appointments, provided this complies with these Terms and the law.

19.8. The User may object to the measure taken at destek@randevi.org; the Platform Operator examines the objection and notifies its outcome in writing. The User's right to apply to the courts and to the competent authorities is reserved.

19.9. The end of the contract does not affect the rights and obligations that arose up to that date. Provisions that by their nature must continue to apply after the end of the contract, in particular Sections 12, 16, 18 and 22, remain in force.

19.10. A Business whose Subscription has ended continues to view its records on a read-only basis. After the closure of the Business or the end of the contract, for as long as their account remains open, the owner of the Business may request, at destek@randevi.org, a copy of the Business's appointment, service, specialist and transaction records and of its correspondence with the Platform Operator; the Platform Operator fulfils the request within 15 days. Personal data belonging to Customers is included in this copy only within the limits in Section 12 and to the extent permitted by legislation. When the owner deletes their account, this possibility ends and clause 12.6 applies to the data covered by clause 12.4; clause 19.4 is reserved.

20. Changes to these Terms

20.1. The Platform Operator may change these Terms only for the following reasons: compliance with changes in legislation or in decisions of competent authorities; the addition of a new feature or service to the Platform, or the modification or removal of an existing feature; security or technical requirements; the updating of the Subscription price, periods or scope because of a change in costs, taxes, Store conditions or the scope of the service; making the text clearer or correcting errors.

20.2. Changes are announced at least 15 days before they take effect, by in-app notification or by a message sent to the User's registered email address. Notices of changes addressed to Businesses are given through both of the channels specified in clause 23.2. The announcement clearly states the content of the change, its effective date and the User's rights.

20.3. Material changes that have adverse consequences for the Business, for example an increase in the Subscription price or the tightening of the rules on restriction, suspension or termination of the service, are announced at least 30 days in advance.

20.4. A User who does not accept the change may close their account without paying any fee until the effective date; in that case the Business may end the contract without paying compensation. A User who continues to use the Platform after the effective date is deemed to have accepted the change; however, changes that have adverse consequences for the Customer, other than those made as required by legislation or by a decision of a public authority, do not apply to a Customer unless that Customer expressly approves them. In the other cases where legislation requires express approval, the User's express approval is likewise obtained.

20.5. Changes that are solely in the User's favour, that relate to a new feature, or that must be applied immediately as required by legislation or by a decision of a public authority may take effect on the date they are announced.

20.6. Changes are not applied retroactively and do not have adverse consequences for the User in respect of appointments created before the change.

20.7. The current version of the Terms is published in the Legal section of the apps and at randevi.org/yasal/terms. Because the text in the mobile apps is refreshed with an app update, the most current version is the version on the website. The User may request a copy of the version they accepted at destek@randevi.org.

21. Additional provisions relating to app stores

21.1. These Terms are between the User and the Platform Operator; Apple and Google are not parties to these Terms. Use of the apps is also subject to the usage rules of the Store from which they were downloaded.

21.2. Where the app has been downloaded from the Apple App Store, the following provisions also apply.

a) The permission to use granted to the User is limited to use of the app on Apple devices that the User owns or controls, in the manner permitted by the App Store usage rules.

b) Maintenance and support of the app are the Platform Operator's responsibility; Apple has no obligation to provide maintenance and support for the app.

c) If the app fails to conform to an applicable warranty, the User may notify Apple, and Apple will refund the purchase price paid for the app, if any. To the maximum extent permitted by legislation, Apple has no other warranty obligation in respect of the app.

d) The Platform Operator, not Apple, is the addressee of User or third-party claims relating to the app, including product liability claims, claims concerning legal compliance, claims under consumer and personal data legislation and claims of intellectual property infringement.

e) The User declares that they are not located in a country subject to an embargo by the United States of America and are not on any list of prohibited or restricted parties.

f) When using the app, the User is required to comply with their agreements with third-party service providers such as their mobile network operator.

g) Apple and its affiliates are third-party beneficiaries of these Terms; when the User accepts these Terms, Apple has the right, as a third-party beneficiary, to enforce these Terms against the User.

22. Governing law and resolution of disputes

22.1. These Terms are governed by the law of the Republic of Türkiye.

22.2. In the event of a dispute, the User may first apply to the Platform Operator at destek@randevi.org; the Platform Operator makes a good-faith effort to resolve the dispute through discussion. Such an application does not affect the User's right to apply directly to the remedies below.

22.3. For Customers: pursuant to Article 68 of Law No. 6502 on the Protection of Consumers, in disputes below the monetary limit announced each year by the Ministry of Trade (TRY 186,000 for 2026), the provincial or district consumer arbitration committee in the place where the Customer is resident or where the transaction took place has jurisdiction. In disputes above that limit, the Customer may apply to the consumer court, provided that they first apply to a mediator before filing a lawsuit pursuant to Article 73/A of the same Law; the lawsuit may also be filed in the consumer court of the Customer's place of residence.

22.4. In disputes concerning the Business Service, the Customer may also use the same remedies against the Business. No provision of these Terms limits the consumer's right to apply to the competent authorities and courts.

22.5. For Businesses: in disputes between the Platform Operator and Businesses that have the status of merchant, the courts and enforcement offices of Istanbul have jurisdiction pursuant to Article 17 of the Code of Civil Procedure No. 6100. For Businesses that do not have the status of merchant, the general rules of jurisdiction apply. In commercial disputes whose subject is the payment of a sum of money, applying to a mediator before filing a lawsuit is mandatory pursuant to Article 5/A of the Turkish Commercial Code No. 6102.

22.6. In disputes with Businesses, the Platform's appointment, confirmation, notification and transaction records may be used as evidence; the Business's right to prove the contrary is reserved.

23. Contact and notices

23.1. The Platform Operator can be reached through the following channels: by email at destek@randevi.org; through the Support section of the apps (which opens, in the email app on the User's device, a draft addressed to this address); by post at Mimar Sinan Mahallesi, 194. Sokak, Güzelbahçe Sitesi, No: 7-9, Atakum / Samsun.

23.2. The Platform Operator gives its notices under these Terms by in-app notification or by a message it sends to the User's registered email address. Notices addressed to Businesses that are provided for in clause 19.7 and Section 20, however, are given through two channels together: the notification centre in Randevi Business and, in addition, the email address or telephone number that the Business has notified to the Platform Operator. The User is required to keep their contact details up to date.

23.3. Businesses submit their applications to the Platform Operator by email at destek@randevi.org; the Support section of Randevi Business opens a draft addressed to this address. The Platform Operator concludes the application within 15 days at the latest and notifies the Business of the outcome in writing. The current version of these Terms can be viewed at any time in the Legal section of Randevi Business; the Business may request a copy of the version it accepted under clause 20.7.

23.4. Between merchants, the formal requirements in Article 18(3) of the Turkish Commercial Code No. 6102 are reserved in respect of notices and warnings concerning default, termination and rescission of the contract.

23.5. How requests concerning personal data are to be made is explained in the KVKK Disclosure.

24. Final provisions

24.1. If a provision of these Terms is held to be invalid, this does not affect the validity of the other provisions.

24.2. The Platform Operator's failure to exercise a right, or its delay in exercising it, does not mean that it has waived that right.

24.3. The User may not transfer their rights and obligations under these Terms to someone else without the Platform Operator's approval; the transfer of ownership in clause 13.14 is reserved. If the Platform Operator transfers the operation of the Platform to another person by way of merger, acquisition or transfer of business, it informs Users in advance; a User who does not accept the transfer may close their account.

24.4. These Terms were drafted in Turkish. Translations into other languages, including this English text, are for information only; the Turkish text is authoritative and, in case of any conflict between a translation and the Turkish text, the Turkish text prevails.

24.5. These Terms entered into force on the date stated below.
